Mombasa Governor Ali Hassan Joho has been handed a reprieve after former Senator Omar Hassan decided to withdraw a suit appealing the decision of a High Court decision upholding his election.
Joho and IEBC will receive Sh1.5 each from the former Senator in compensation for the suit filed against them.
Through lawyer Yusuf Aboubakar, Mr Omar and his running mate Linda Shuma asked the court to drop the case filed against Joho.
The second term governor through his lawyers Mohamed Balala, Paul Buti and Dennis Mosota agreed with the move of the former senator, who ditched Wiper to Jubilee after losing the election in August 2017.
The hearing Appellate judges Alnashir Visram, Martha Koome and Sankale ole Kantai were forced to postpone the hearings twice.
“The appellants (Mr Omar and Ms Shuma) and the third respondent (Mr Joho) have further agreed that the costs awarded in the High Court be revised to Sh1.5 million only,” read part of the consent.
Omar and Shuma failed to prove allegations that Joho engaged in bribery and ballot paper stuffing during the elections.
The judges said that the irregularities that Omar lamented about were not gravy as he claimed during the filing of the case. Omar has since been silent after moving to Jubilee.
