Ford Kenya party leader Moses Wetangula has faulted the Senate led by Speaker Ekwe Ethuro for breaching the Constitution in passing the controversial election laws.
Wetangula says that Ethuro had stopped being objective and was now being used by Jubilee to push the government's agenda.
According to the senator, Ethuro unlawfully allowed ineligible people to vote on the Bill, thus bringing the question of authenticity of the final decision.
“We indict our speaker and we are going to take necessary legal action to redress this. It is a sad day for the country when the speaker of the Upper House, the House of reference, the House of reason, the House of revision, rigs an election because he is conducting the business not as the speaker of the house but a representative of the Jubilee regime in the Senate,” Wetang'ula said.
He accused Ethuro of allowing an ineligible Senator (Hosea Onchwang'i) to cast his vote on behalf of Kisii senator Chris Obure who was absent from the Senate chambers.
Samburu Nominated Senator Naisula Lesuuda was also allowed to vote in the same manner.
His sentiments were echoed by the Wiper counterpart Kalonzo Musyoka who said that nothing was supposed to be added or removed from an earlier election laws document that was written by legislators from both sides in Parliament.
“This (election laws document) was a negotiated document and there was not supposed to be an additional coma or a full stop beyond what was actually agreed so this country would know a free, fair and predictable election,” he said.
“What happened in the Senate was child play. If you rig elections at the Senate level, what will happen in the August elections?” he asked.
