[Photo/Citizen]One of the interested parties in the National Super Alliance (Nasa) presidential petition, Thirdway Alliance presidential candidate Dr Ekuru Aukot gave his submissions in court on Monday.During the first hearing, Aukot through his lawyer Elias Mutuma, told the Supreme Court that he wanted to know the consequences of failing to abide by the law, following 'massive anomalies' in the presidential election, by the Independent Electoral and Boundaries Commission (IEBC).According to him, he is not challenging the outcome of the election which saw IEBC declare President Uhuru Kenyatta winner in the August 8 polls, but rather wanted the court to shade more light, to his findings.Aukot said an audit by his party discovered various election irregularities such as cases of opened ballot boxes and improper accreditation of number of votes to him, in forms 34A and 34B."The court ought to review the actions of the commission to establish whether the qualitative standards have been achieved," said Mutuma, adding that "where election managers are below those standards, then the results must be impeached."He further argued that he had conceded defeat after coming in number five, in the race of eight presidential candidates, but it did not mean IEBC was given clean bill of health.However, IEBC lawyer Paul Muite dismissed Aukot's argument, saying his affidavits rhymes on the 'evidence' and argument used by the petitioner, Nasa.According to him, Aukot did not have evidence to prove his allegations, and so the court should dismiss his case.
