Three people were on Thursday arraigned before a Kisumu chief magistrate court to answer to the charges of drinking before the stipulated time.
Anne Okeyo, Joseph Opiyo and Kevin Omondi denied the charges before Kisumu chief magistrate Lucy Gitari for the offence they are alleged to have committed on May 12 in Kisumu.
The court heard that the three were arrested in a local pub located in Kisumu’s Nyalenda estate drinking at 3pm instead of 5pm, the stipulated time.
The prosecution told the court that the three had locked themselves inside the bar while drinking, before they were arrested and taken to the Nyamasaria police station.
However, in his defence, Okeyo told the court that she was not drinking but worked as a bar maid preparing the place for opening.
The second accused told the court that he was inside the bar at that hour because he was making alcohol delivery, and they were just tasting if it was okay.
However, Omondi told the court that he did not have to give any explanations because he owns the place.
“I was arrested at my own premises, is it a crime to be at your place?, posed Omondi before the court.
Gitari released them on a cash bail of Sh5,000 each with surety of a similar amount pending the hearing of the case on June 25.
