President Uhuru Kenyatta's easily may be nullified should any Kenyan challenge his victory, notes Nzamba Kitonga, one of the drafters of the 2010 constitution.

Although the opposition has dismissed any plan to move to court for the second time, activist Okia Omtatah has already shown intentions of filing a petition.

"Uhuru's victory could be nullified on the grounds that nominations were not done by political parties," he said adding that the September ruling by the Supreme Court that ordered for fresh elections could ignite a hot debate.

According to him, the term fresh elections could be interpreted that the process was to start afresh by allowing any interested party.

Prof Mutakha Kang'u on his part notes that the elections exposed numerous illegalities and irregularities that could easily be proved in court.

"There were a lot of illegalities and irregularities in Forms 34A and 34B and this will be easilyu detected in court."

He further says: "We also have issues raised by Wafula Chebukati on Ezra Chiloba. He even said he would not guarantee a free and fair election and never retracted that. Someone could file an affidavit on the same."

IEBC declared Uhuru a winner of the repeat poll having scored 98 percent of votes cast in an election that was boycotted by Raila Odinga.
