A Kisumu chief magistrate court has charged three people with assaulting a man.

Tom Okila, Haron Ogolla and Cyprian Okoth on Wednesday denied the charges before Kisumu chief magistrate Lucy Gitari for the offence they allegedly committed on May 1, in Kisumu.

The prosecution told the court that the three assaulted Aggrey Okundi, while at his compound following a disagreement over a failed business deal.

The first accused, Tom Okila, is the one who had a deal with the complainant. After informing his friends about the deal, they allegedly decided to go and attack Okundi and injured him badly.

Okundi was admitted at the Kisumu East district hospital for two days before being discharged.

Okundi had reportedly agreed to help Okila purchase clothes from Uganda but he failed and did not return the money given to him by Okila.

The three were arrested on May 2, after the matter was reported to the police.

The prosecution unsuccessfully tried to block their bail application by claiming that they might injure the complainant but the magistrate was not convinced by the presentation.

They were released on a cash bail of Sh5, 000 each with surety of a similar amount pending the hearing of the case on June 20, 2015.
