Three people were on Wednesday charged with murder at a High Court in Kisumu.
The particulars of the offense were that Nicholas Owiti, Elisha Ousa and Denis Omondi jointly with others who were not before court assaulted and murdered Francis Ojowi at Luanda Kotieno Beach in Naya, Rarieda a Subcounty in Siaya County.
The circumstances of death were that the deceased was beaten by mob and burnt to death.
During the hearing of the case, the widow of the deceased Emily Akinyi told the court that on the fateful night the husband had escorted a cousin to the grandmothers’ home but after some few minutes he had some loud commotion and when she went out, it was the husband that had been beaten up on grounds that he was a thief.
She said that on the scene were Mr Owiti, Mr Ousa and Mr Omondi who both participated actively in the incident.
They were armed with pangas and rungus court heard.
She said there was a fourth person who was not before court who poured petrol on the deceased and Owiti lighted a match stick.
The accused had earlier pleaded to be released on bond stating that they were the sole bread winners of their homes and that their children were almost being rendered destitute as they were remanded in prison.
They also argued that it was within their constitutional right to be released on bond or bail pending the hearing and the determination of the case.
The case will be heard on July 7.
