The decision of the Supreme Court to disallow the use of alleged IEBC memos has definitely weakened the case of the petitioners, who are seeking the nullification of the second presidential election. The alleged internal memos, obtained illegally, are now largely seen as NASA’s propagandist documents meant to support Raila Odinga’s positions during the election period. Former IEBC commissioner Roselyn Akombe, who is accused of leaking the memos — some of which she wrote — to the public, has been accused of being part of a well-scripted plot to get Raila to State House through the backdoor. After realizing that she was destined for failure, Dr Akombe fled to the United States, from where she announced her resignation. Kenyans widely condemned her for betraying her country. Although the court has stopped NASA from being a party in the petition, the petitioners have close links in the opposition, and they are believed to be operating under the instructions of Raila, who wanted to challenge the election results despite not taking part in the process. There was no way Raila could be allowed by the judges to be a party in the case, since he dropped out of the race. The expunging of the leaked memos from the court documents ends a sad conspiracy meant to bypass the people’s will.
