Director of Public Prosecution Keriako Tobiko has been accused of delaying a case where five senior officials of Imperial Bank are charged with conspiring to defraud the bank Sh29 billion.
The accused persons Naeem Shah, James Kaburu, Nashir Jessa, Zulfikar Jessa and Nargis Jessa have alleged that the prosecution has failed to supply them with witness statements as requested.
While appearing before trial magistrate Joyce Gandani on Thursday, the five complained that other crucial documents in the case were yet to be availed to them.
According to the defence, the prosecution was taking too long to hand them the documents that will allow the case move to the hearing stage.
Gandani, in her ruling ordered the prosecution to supply the documents by October 26.
From there she will set the dates of the hearing in a case where the accused are facing charges of theft of Sh29 billion from Imperial Bank on diverse dates between January 1, 2006 and September 15, 2015 or more.
