The Office of the Director of Public Prosecutions (ODPP) has dismissed claims published in one of the local dailies, that Sh598 million Cocaine case against Briton Jack Alexander Marrian has been withdrawn.

According to Keriako Tobiko, Marrian who was jointly charged with Roy Francis Mwanthi in case number 3285 of 2016 were expected in Court on January 19 and 20, where 19 witnesses will testify against the them.

He clarified that Senior Assistant Director of Public Prosecution (SADPP) James Warui who was prosecuting the case, was yet to make any application for a special mention on December 21, or any-other day as claimed in the publication.

Citing Article 157 of the Constitution, Tobiko noted withdrawal of a case can only come from the DPP.

"The Office of the Director of Public Prosecutions has denied claims appearing in one of the local dailies indicating that Sh598,330,800 Cocaine case against Briton Jack Alexander Marrian has been withdrawn,'' ODPP said in a statement, Monday.

The case was last in Court on November 11, 2016, and proceeded with Head of Anti-narcotics Unit as the first witness with the production of 9972108 grams (99 sachets) of Cocaine as evidence at the Criminal Investigations Department (CID) headquarters.

The Briton is accused of trafficking the narcotics nabbed at Kilindini Port in Mombasa. He was released on a Sh70 million bond with two Kenyan sureties of a similar amount.

The Court directed that he be remanded at the Industrial Area Prison pending processing of the bond.
