Director of Public Prosecution Keriako Tobiko. [Photo/the-star.co.ke]Director of Public Prosecutions Keriako Tobiko has recalled a fraud case file in which former Kitui Rural MP Charles Mutisya is charged with obtaining goods worth Sh 7 million by false pretences.
When the case came up for mention before Milimani senior resident magistrate Hellen Onkwani, the prosecution said the file has been forwarded to the DPP for review and further direction.
The former lawmaker is alleged to have committed the offences between May 28, 2014 and June 3, 2014 in Nairobi.
The court was also told the complainant in the case has also filed a civil suit against the accused persons at the High Court.
Nyamai denied obtaining the goods worth more than Sh7 million by false pretences from city businessman Elijah Kimani that he was in a position to pay for the 706 pieces of wooden treated poles as alleged by the prosecution.
When Nyamai appeared in court for the first time his lawyer Nicholas Kamwendwa asked the court to release him on reasonable bond.
He said Nyamai was by then a Member of Parliament and is not a flight risk.
The magistrate released the accused on Sh 500,000 bond pending hearing and determination of the case.
