Director of Public Prosecution (DPP) Keriako Tobiko has said he will appeal the decision to acquit Kabete MP Ferdinand Waititu and his Gatundu South counterpart Moses Kuria over incitement to violence charges.

According to Tobiko, the acquittal is set back to the fight against hate speech.

 “I have read the submissions from the two parties (the prosecution and the defense) but I am not convinced that their utterances could have led to violence,” she said in her ruling as quoted by the Star.

On Monday, the High Court acquitted the two legislators over remarks they made against Cord leader Raila Odinga.
