Nyaribari Chache MP Richard Tong'i is not yet over the hook as two petitioners have filed a notice to challenge a Kisii Court ruling that upheld his win.
The petitioners, Zaheer Jhanda and James Kenani in a notice said that they are dissatisfied with a ruling by Justice Antony Ndungu two weeks ago.
The two are arguing that Mr Tong'i was not validly elected as MP because the elections were not electronically transmitted.
They also argue that some voters voted without being identified.
The two claims were thrown out by Judge Ndung'u.
Mr Jhanda and Mr Kenani who contested for the parliamentary seat on August 8, 2017, but lost to Mr Tong'i want a fresh election conducted in the constituency.
In his ruling on February 28, Judge Ndung'u said that the petitioners failed to give evidence over the election malpractices.
He ordered the petitioners to pay Sh8.4 million in costs.
