[Photo: IEBC]The Independent Electoral and Boundaries Commission (IEBC) says it will not appeal, after Appellate judges Asike Makhandia, William Ouko and Agnes Murgor ruled that presidential election results declared at the constituency level during election, be final.IEBC filed the case, seeking clarification on whether the results should be declared final by the chairman, Wafula Chebukati, as the national Returning Officer.The National Super Alliance (Nasa) was opposed to the decision by IEBC, and hailed the Court for ruling in its favour.Nasa had accused incumbent Jubilee government of colluding with IEBC to try and doctor August election results, by twisting the presidential results from the Constituency level.IEBC clarified that it was contented with the Court's decision, with Chebukati saying it was not a win or a lose to them."The IEBC accepts the verdict of the Court of Appeal on declaration of results and would not appeal further on the matter," said IEBC, in a tweet.Devolution Cabinet Secretary Mwangi Kiunjuri had raised concerns over the ruling, saying Jubilee Party would partner with IEBC and move to the Supreme Court to appeal the Appellate Court ruling.Nasa presidential running mate Kalonzo Musyoka, hailed the Appellate Court, following ruling, saying it would ensure free and fair elections.
