National Super Alliance (NASA) advocate Nelson Havi now says that former National Assembly Deputy Speaker Farah Maalim has only himself to blame after his petition to quash Garissa town lawmaker Aden Duale's August re-election flopped.

Justice Hedwig Ong'udi on Monday, at the Milimani Law Courts in Nairobi, dismissed the petition for lacking evidence.

The former Lagdera Member of Parliament had cited voter bribery allegations and improper transition of results in the exercise, allegations that Judge has thrown out concluding that Duale was constitutionally elected and therefore upheld his victory.

According to Havi, Mr. Maalim's loss was anticipated as he failed to table sufficient proof to aid in the proceedings, rendering his petition weak.

''Farah Maalim had a good case. Problem is that case was not pleaded or evidence in support put before the Court. In fact, the case was not before the court at all,'' the lawyer said in a tweet on Monday.

Maalim has been directed to pay a sum of 6 million shillings to foot the petition expenses.The money is to be shared equally between the National Assembly Leader of Majority and the Independent Electoral and Boundaries Commission (IEBC).

Duale has since welcomed the outcome terming it as a big win for his constituents.
