There was drama yesterday when Miguna Miguna's lawyers tried to serve police officers with a court order to release Miguna following a successful habeas corpus application.
According to Lawyer Nelson Havi, the police refused to receive the order.
The court order obligated the immigration authorities to produce the controversial lawyer and socio-political commentator in court today.
Nelson Havi, one of the lawyers representing Miguna, told a local media station that they are ready for a tough battle in court today.
''The court has ordered that he be released but as we speak, he is still being held in a filthy toilet. What we can promise them is the toughest battle they have never seen in court,'' a cool Nelson Havi said.
An elite group of lawyers is expected to plead the case for Miguna Miguna to be allowed back into the country.
Immigration officials hold that Miguna should sign certain documents before being allowed into the country.
This now sets the stage for a bitter legal battle in court.
