Peter Musau, 35 the driver of the truck belonging to Mombasa Canvas Company and his assistant Mohammed Noor, 30 appeared before Nakuru Chief Resident Magistrate Samuel Mungai to face the charges which they committed on February 23 this year.

The prosecution desk held that the accused were arrested by Highway Authority officers who were on patrol along Nakuru-Eldoret Highway.

The magistrate heard that the accused had reloaded the truck with more goods after having eluded weigh bridge officers in Gilgil a few hours earlier.

The prosecution desk also told the court to subject the accused to a heavy punishment to serve as an example to other truck operators who had formed a habit of playing a hide and seek games with law enforcers concerning the required transit goods measures.

The prosecution observed that some truck drivers and their assistants were working behind their employers' backs to engage in illegal transportation deals thus breaking the laws put in place to regulate the transport sector.

The accused who pleaded guilty to the charges were ordered to pay a fine of Sh30,000 each or face a jail term of 6 months each.
