The Teacher Service Commission secretary Gabriel Lengoiboni on Thursday moved to the High Court seeking to quash orders directing the Inspector General of police to arrest him over contempt of court.
Through lawyer Paul Otieno, the TSC Secretary filed an urgent application in which he urged Justice Janet Mulwa to discharge the order dated March 12.
The court order had directed the Inspector General of police Joseph Boinet to arrest the TSC boss within 60 days and escort him to Kamiti Maximum Prison to serve six months imprisonment for contempt of court.
The police boss as of yesterday was yet to arrest Lengoiboni. This was after Lengoiboni went back to court and applied for a stay against the orders granted by the same court.
Lady Justice Mulwa suspended the orders last week Tuesday pending determination of the application, which the TSC boss filed seeking to have the orders discharged.
However, the lawyer representing the retired teachers Mr Dominic Kimata on Thursday termed the suspension of the orders unfair, as he was not informed when the order was suspended.
He noted that by suspending the orders, the court took away what his clients have been fighting over for the last ten years. Kimata pleaded with the court not to give audience to the TSC boss unless he purged the contempt, as he deserved to be behind bars.
"The TSC boss is due for retirement in June following a media announcement of the vacancy of the position thus by lifting the orders it will shatter what they have been fighting for,” he said.
Kimata accused the government of frustrating his clients in an effort to ensure justice is scuttled and they will ‘die’ before receiving their dues.
“Several pensioners have since died after their retirement 17 years ago and while waiting for justice during the 10 year court battle which is so unfortunate,” he said.
Justice Mulwa slated the ruling of the matter for July 30.
