Turkish firm has been put on the spot for allegedly constructing a ferry that does not meet the required standards.
Appearing in court on Tuesday, Marine survey experts, Bonriz Insurance Marine Surveyors requested that Ozata Tereane Company should stop the construction of the second ferry.
Bonriz Insurance Marine Surveyors indicated the firm constructed the first ferry - MV Jambo, worth Sh1 billion but failed to meet the standards prescribed in the contract.
Lawyer representing the Insurance firm, Joseph Kinyua appeared before the Mombasa Appellate Court where he said the first ferry that Ozata Tereane Company delivered in 2017, had a defective heating engine.
Before the ferry was delivered in Kenya, Kinyua told justices Wanjiru Kariuki, Martha Koome and Alnasir Visram that his client raised the concern.
Bonriz Insurance Marine Surveyors filed the submission in response to an appeal filed by the Kenya Ferry Services (KFS) which wants the court to overturn an order given by the High Court that stopped the construction of the second ferry by the Turkish company.
The two ferries were to be constructed and commission at a cost of Sh2 billion. After signing the contract with the firm, KFS sought Bonriz Insurance Marine Surveyors for consultancy project supervision, but cancelled the agreement on June 30, 2017, prompting the surveyors to contest the decision at the High Court.
Bonriz successfully obtained an order stopping construction of the second vessel but failed to stop the delivery of MV Jambo, which was commissioned by President Uhuru Kenyatta n July 2017.
