Two brothers were on Tuesday arraigned in a Nakuru Law Court face charges of perpetrating brutality against a harmless domesticated animal, thus causing its untimely death.

Eugine Mose, 24 and his elder brother Vincent Mose, 28 denied the charges before Chief Resident Magistrate Samuel Mungai that on March 22 this year at Makao Estate within Nakuru County they jointly plotted to poison a dog that belongs to their neighbour Philip Karanja.

The prosecution desk told the Magistrate that witnesses had informed the complainant that the plan to poison the dog was hatched several days by the accused who had been overheard by a friend how they could acquire a poisonous substance that could be used to poison a dog to death.

The Court further heard that the accused had on several days in the past complained to the dog’s owner about alleged disturbance by the dog and had also been overheard by other witnesses threatening to poison the dog to death as it was causing untold nuisance.

The Magistrate heard that on that material day, the accused who live together in their family’s homestead in the area allegedly bought pieces of meat which they treated with a poisonous substance and threw it at the dog when it ventured into their compound at around 7pm.

The Court was told that the complainant had carried out investigations after he discovered his dog dead near his home the following day and reported the matter to Teachers Police Post before the accused were arrested.

The accused however denied the charges and were released on a cash bond of Sh10,000 each. The case will be heard on April 23 this year.
