The two Joseph Munga, 39, and Moses Njihia, 30, from Makuyu in Murang’a County appeared before resident magistrate Esther W. Mburu and pleaded innocent to the allegations levelled against them.

Stellah Oyagi who is the prosecutor said the two are said to have killed a middle aged man who is their elder brother on April 25 this year after several land rows emerged.

According to Nancy Kaguta, who lives near the house of the deceased, the two came to the home of Mary Nyakio on Saturday evening armed with fighting canes and a panga and later engaged in a disagreement.

The two are said to have been against the way their father’s land was shared and thus wanted answers from the brother who facilitated the inheritance sharing.

There was a standoff during that evening which came after the two were referred to a land surveyor (Boniface Muiruri) in Thika who administrated the sharing. Munga and Njihia started fighting their brother until he bled.

According to Agnes Wanja, the deceased’s wife, she tried to bring to a close the disagreement after speaking to the two but her efforts were futile.

After leaving the homestead, the wife took her husband to Makuyu hospital for medical check-up but since the wounds were serious, they were referred to Thika Level Five Hospital where but the husband died before arrival.

The wife reported the matter immediately to Makuyu Police Station and the two accused were arrested from their homesteads in Makuyu on Sunday, April 26 and a murder case filed against them.

The two rejected the accusations and told the court that their older brother was suffering from Typhoid which led to his death.

They requested the court for release them on cash bail or a bond which the prosecutor objected.

They will remain in custody until June 26 to allow investigations to be done and a report from the police is expected in court on the same day.
