Two middle-aged men were on Wednesday arraigned in a court in Nakuru to face charges of trespass and theft.
According to the prosecution desk, Wilson King’ori, 30 and Japheth Waweru, 27 on the evening of January 17 this year at Milimani area in Nakuru, while operating a pick up van, illegally drove into a private land owned by one Charles Kairu and started harvesting volcanic rocks without permission from the owner of the property.
The court under the precision of Chief resident Felix Kombo heard that the accused, who are employees of Harmony Land scampers intended to transport the rocks to a construction site their employer had been contracted.
The prosecution added that the property owner was informed by a neigbour of the happenings, before he reported the matter at Nakuru Central Police Station and thereafter was accompanied by police officers to the scene of crime immediately.
The magistrate was told that the accused were arrested while preparing to drive out of the property, after having harvested a substantial quantity of rocks estimated at a value of Sh30,000.
The accused however denied the charges and claimed that they were instructed by their supervisor to drive at the site and harvest the rocks, and thought the owner had been consulted.
They were released on a cash bond of Sh50,000 before the hearing of the case on February 18.
