Two men were on Friday arraigned before a Kisumu Chief Magistrate court to answer to charges where they are accused of fraud.

The two; Martin Okemo and Harrison Gweyu, who are accused of fraudulently acquiring passports from the Kisumu immigration offices denied the charges before chief magistrate Thomas Obutu.

The court heard that the two Kisumu-based businessmen were arrested on 20th of this month in Kisumu, after allegedly giving false information in acquiring the passports.

The defence lawyer Patrick Okwiri asked the court to dismiss the case because the prosecution was using lapses at the immigration offices to prosecute innocent Kenyans.

Okwiri argued that the documents had already been processed and ready to be issued when it was discovered that some of the information given was false.

He said such a thing a thing should have been detected at the first stage.

However, the prosecution responded by saying the false information was availed to them in the very last stage during verification, something that is always done before any document is issued out.

The prosecution unsuccefully failed to block the accused bail application.

They were released on a cash bail of Sh20,000 with surety of a similar amount.

Obutu asked the two to surrender all their travel documents before the court pending the hearing of the case on the 26th of this month.
