Two men were on Monday charged with possessing 300 grammes of heroin with a market value of Sh900,000 before a Kisumu court.

Felix Ouma and Elijah Ongoro were presented before chief magistrate Lucy Gitari and denied being found with the narcotic drug on October 24 at Nyamasaria in Kisumu.

They were remanded in police custody for three days to help the police with investigations, on the prosecutor’s request. The drug was taken to the government chemist for analysis.

The prosecutor submitted that they be denied bail on grounds that investigations were not complete and releasing them would jeopardise the case.

The investigating officer presented an affidavit asking the court to remand the two for five days pending the investigation.

The magistrate, however, only allowed three days, after which the accused may be released on bond terms.

She said a suspect is constitutionally under no obligation to aid the police in mounting a case against them.

“I have, however, considered the application by the prosecution and I will allow only three days,” she said.

It will be mentioned again on Thursday when a hearing date will be set.
