Two middle-aged men have been arraigned in a Thika court and charged with assaulting their mother in a land dispute
Joseph Ndung’u and Thomas Makau appeared before resident magistrate Esther Mburu and charged with the offence of beating their mother and causing injuries to her.
The court heard that on September 9, 2014 in Kilimambogo area of Thika sub-county, the suspects jointly beat up their mother ruthlessly while demanding for a piece of land to be divided amongst them, a matter which their mother was opposed to.
The court heard from the first witness, mercy Wairimu - who is a medical officer from Thika level 5 hospital - that on September 9 while in her night shift, a patient was brought to her while with severe cuts on her head and back and she administered first aid before asking for a p3 form.
She said that the victim had been beaten brutally as she had remains of wooden splits in her body.
The prosecution told the court that one of the accused, Ndung’u, had previously been charged with being in possession of narcotic drugs (bang) and was jailed for six months.
The court also heard that the two went into hiding until when they were arrested by the police on February 7 and brought to court on that day.
The two denied the charges and were released with a cash bail of Kenya shillings Sh500,000 with a surety bond of the same amount.
The two asked the court to grant them a lower bail which they can afford but the magistrate reminded them that the case facing them was very serious and would only be covered with not less the amount.
The case was scheduled to be heard on February 26.
