Two NASA legislators have come out to support the 43 NYS suspects after the court denied them bail on Tuesday meaning they will still be remanded until end of their trial.
According to Rarieda MP Otiende Amollo and Makueni Senator Mutula Kilonzo Jnr, the move to deny the suspects bail should not be celebrated since it mocks the gains made by Constitutional changes.
"I am sorry I cannot celebrate abrogation of hard-fought Constitutional guarantees. There can be no rational reason for blanket denial of bail before culpability of suspects. The blind cheerleading is dangerous," said Otiende.
According to Mutula, the denial of bail was bad since it denies the suspects a right enshrined in the Constitution.
"The grant or denial of bail is not automatic and neither is it issued as a matter of course," said Mutula.
"The NYS suspects have a right to challenge the denial of bail at the High court. All said and done these cases will be precedent-setting," he added.
Others lawyers who condemned the ruling passed by Judge Douglas Ogoti include Ahmednassir Abdullahi and Nelson Havi. However, a section if Kenyans commended Ogoti for the judgment after claims that court injunctions have been depressing the fight on graft.
