Two politicians from Mandera County have said that they will appeal at the High Court in Garissa next week over a magistrate court’s ruling that upheld party nominations of two MCAs.

Mr. Hafid Maalim Ibrahim and Mr. Mohamed Ali Bashir had filed a petition seeking court orders to nullify the nomination of Ms. Halima Billow Omar and Mr. Issack Dahir by the Economic Freedom Party (EFP).

Speaking on Thursday at a hotel, Mr. Ibrahim who said that he is dissatisfied with the ruling added that the magistrate court failed to deliver justice.

“That ruling in Mandera denies us justice but we shall appeal so that justice can be served,” he said.

Mr. Ibrahim told the court that, under negotiated democracy plan, clan elders and the EFP leadership, asked him to shelve his ambition to run for Rhamu MCA and promised that he would be nominated to represent persons with special needs at the Mandera County Assembly.

Mr. Ibrahim said he agreed to the decision and he invested his money in EFP political activities only for cartels at the party headquarters to name other people claiming that IEBC worked with EFP to remove his name from the list of nominees.

He told the court that Ms. Omar who was nominated for the position of a person living with disability is not disabled as claimed by EFP

The two petitioners further argued that Mr. Dahir’s nomination was fraudulent as he had applied for the business category when he was Rhamu MCA but he was given the youth representative position which was meant for Mr. Bashir.

Mandera Senior Resident Magistrate Peter Areri in his ruling said that the two petitioners failed to prove allegations of breach of political party nomination rules.

Magistrate Areri further ruled that Mr. Dahir and Ms. Omar were nominated by EFP as MCAs according to the law and the Constitution.
