Two people were on Thursday arraigned before a Kisumu Chief Magistratecourt to answer to charges of defrauding a businessman Sh300, 000.
Joseph Kwena and Agnes Ndeti denied the charges for the offence they are said to have committed on diverse dates between March and July last year in Kisumu City.
The court heard that the two Teachers Service Commission (TSC) employees defrauded Kashman Ilhal the money by claiming they had knowledge of the British syllabus and could tutor his three children.
The money was paid in instalments on a weekly basis.
However Ilhal later discovered that his children were being taught the Kenyan syllabus after going through their work. He reported the matter to the police who arrested the first accused in Kisumu town in December last year, while Ndeti was arrested on March 1 of this year.
The case could not proceed as Ndeti was still on the run and Kwena has been remanded since December, as the police could not prosecute him as they jointly committed the crime. The prosecution objected the bail application by the accused on the ground that they could still mislead other people in the name of teaching them the British syllabus.
Kisumu Chief Magistrate Lucy Gitari however released each on a cash bail of Sh50, 000 with surety of a similar amount. The case will be heard on May 20.
