Former Member of Parliament David Ochieng’ will tomorrow know his fate regarding his election petition challenging the victory of Christopher Karani as the newly elected Ugenya MP.
The judgment will delivered at Kisumu High court by Justice Thrispisa Cherere.
Ochieng’ moved to court after losing the contest with less than 500 votes claiming that his rival garnered used rumors and hate speech against him to gain political mileage.
He also alleged that the IEBC did nothing to address the maligning of his name that culminated to his predicament.
Ochieng’ had earlier on told a Kisumu court that Karani who vied for the MP seat on an ODM ticket told the electorate that he had a hand in the murder of the late IEBC technology boss Chris Msando.
“In his campaign trails among other ODM leaders, they accused me of conniving with President Uhuru Kenyatta to kill Msando,” stated the former MP.
He also blamed the ODM camp of telling citizens that his party Movement for Democracy and Growth (MDG) was a product of Jubilee party and if he would have become MP he would side with other Jubilee legislators to oust Raila Odinga who was running in the Presidential race.
Ochieng’ also accused Siaya senator James Orengo of telling the electorate that they could be seen from ODM offices in Nairobi immediately they placed their fingers on the electronic voting machine.
“He used to tell them, especially illiterate voters that they could know whom they voted for and if it was Ochieng’ they would be followed and questioned on the same,” Ochieng’ stated before a Kisumu court.
The IEBC which was listed as a respondent had prayed before the court through advocate Raymond Olendo to dismiss the petition due to lack of profound evidence and slap both the petitioner and other respondents with Sh10 million fine.
On his side, Ochieng’ said if the elections could have been conducted in a free and fair manner, his political terrain would not have flopped and therefore asked the court to have him paid sh7 million in compensation.
