President Uhuru Kenyatta could after all be the luckiest winner in the Supreme Court full judgment following the apex court’s decision to exonerate him from various election offences.
During the submission at the Supreme Court, lawyer Okong’o Mogeni had claimed that the president breached various electoral code of conduct including threatening civil servants, misusing public resources and using civil servants in his campaigns.
A detailed judgment read by Chief Justice David Maraga on Wednesday however, did not found him guilty in any of the offences.
“Having gone through the evidence given by the petitioner over alleged breach of the code of conduct, we are hereby convinced that the third respondent conducted himself properly,” said part of the ruling.
“The petitioners failed to prove beyond reasonable doubt that in deed various elections acts were contravened.”
Should he have been found culpable, Uhuru could have suffered a double tragedy given that his victory had been nullified.
Election offences amount to prosecution and even blacklisting of candidates from participating in elections.
