A fresh legal battle looms after it emerged that President Uhuru Kenyatta’s lawyers will head back to court to seek re-counting of presidential votes cast on August 8.
According to The Standard, the president’s lawyers will file a judicial review of the Supreme Court’s decision to nullify his victory.
A source told the newspaper that the decision to petition the court’s decision has been approved “at the highest level” within the presidency.
Uhuru’s lawyers are believed to be fine-tuning the new application that could trigger a fresh legal battle with the National Super Alliance (Nasa).
The decision to go back to court is understood to have been triggered by the Supreme Court’s order that the ballot boxes used in the August 8 polls be preserved according to the law.
The Jubilee Party’s position is that the votes cast on August 8 should be re-counted in public.
This comes after the cabinet approved a Sh10 billion budget for a fresh presidential poll, scheduled for October 26.
Jubilee Party Vice Chairman David Murathe said the petition for judicial review will officially be filed next week with a view of having ballot boxes opened and votes counted.
“The first thing I need to tell you is that we are ready, completely ready for a fresh election. But it has become abundantly clear that our competitors are not interested in another election. Because the Supreme Court said the problem was in transmission, we would like the will of the people as expressed in the August 8th election to be validated and there will be no need for a repeat election,” he told The Standard.
