President Uhuru Kenyatta’s successful application that saw NASA coalition expunged as one of the respondents in Supreme Court No. 3 of 2017 case would, after all, affect him negatively, says John Mokaya.

Through lawyer Fred Ngatia, Uhuru argued that NASA had used the opportunity to ‘sneak in ‘new petition in Mue-Khalifa case.

“The fact is that the withdrawn candidate is not a candidate at all. He has simply gone out of the picture,” he said.

In the case, the petitioners argued, NASA had a right to respond following the withdrawal of Raila Odinga from the race.

And Mokaya now says IEBC will be tasked to explain why they included Odinga’s name despite his decision to abandon the election.

“In my opinion, removing NASA from the case even puts Uhuru Kenyatta at a bigger risk. IEBC will now have to explain why Odinga was included in the race. They should not have made the application.”
