President Uhuru Kenyatta has lashed at political activist Okiya Omtatah over his recent petition at the Supreme Court to challenge the outcome of the October 26 repeat polls.
The president termed the move as an abuse of court process.
Uhuru said Omtatah has failed to produce sufficient evidence to support his claims of electoral malpractices.
The activist had gone to court on grounds that the president was competing nobody in the election after withdrawal of NASA leader Raila Odinga.
But through his lawyers, the president said every candidate who took part in the August 8 polls was also on the ballot in the repeat exercise.
“It is common knowledge that the name of Raila Odinga was on the ballot as a candidate in the fresh election. The only inference that can be drawn from this is that IEBC did not receive any valid notice of withdrawal from NASA,” said Jubilee Party director of legal affairs Marykaren Kigen.
“The proper interpretation of the Constitution is that elections are to be cancelled only where a candidate dies or no one has been nominated,” she said.
