Attorney General Githu Muigai has dismissed a possible lacuna in Kenyan leadership should IEBC fail to hold elections within 60 days after the nullification of president Uhuru Kenyatta’s victory.

Supreme Court ordered IEBC to carry elections within 60 days and the commission has already set October 26th as the day for the fresh polls.

And to reinforce President Uhuru Kenyatta’s remarks, Muigai now says Uhuru will remain in power until elections are held.

“Any attempt to form government outside the constitution is illegitimate and there is nothing like transitional government.

“The sitting president will remain in power until the new one is sworn in. That is the basic interpretation of our constitution,” he said.

A divergent view by lawyer James Orengo held the view that Uhuru will have to vacate office in the event elections are not held within the stipulated time.

He contended that a transitional government will be set to oversee elections in another 60 days due to an impending constitutional crisis.
