Ex-Kitutu Masaba MP and Jubilee party presidential Chief Campaigner Walter Nyambati has moved to Kisumu Appellate Court to challenge Governor John Nyagarama's victory.
Last month, Justice James Makau dimissed Nyamabati's petition on grounds that it had not fully substantiated electoral fraud allegations.
Legal team led by Alphaxard Mogikoyo, expressed confidence that the veteran politician will get justice in the Appeal's Court.
"We disagreed with High Court decision that is why we have appealed the ruling. The Judge failed to deliver justice.
"We have compiled 91 volume of evidence where we have cited issues that would easily overtun the ruling," said Mogikoyo.
Among issues raised in the appeal include alleged massive irregularities in 46 polling stations and recruitment of county government staff by the IEBC.
During the August polls, Nyagarama of ODM, was declared winner having garnered 65, 000 votes to Nyambati's 59, 000.
