Celebrated lawyer Fred Ngatia on Monday caused a stir in Kisumu's Appeals Court following Justice Simon Muhandia attempt to block his submission on alleged staffing in 132 polling stations in Nyamira gubernatorial race.

Petitioner Walter Nyambati had moved to the court to challenge an earlier decision by High Court Judge James Makau who had upheld Governor John Nyagarama's victory.

Citing Nyagokiania Polling Station, Ngatia argued, the voter turnout according to IEBC was 400 but the total number of votes cast was 532, an excess of 132 votes.

"The High Court Judge conceded that there were irregularities but threw out the petition on the basis that Nyambati did not show how massive they were," he protested.

He added: "My Lord, you colleague was insensitive and we cannot allow the purported winner to walk Scot free on the massive theft."

In his filed defense, Governor Nyagarama accused Nyambati of introducing new evidence thus urging the court to dismiss the petition.

"In the High Court, the petitioner claimed that irregularities affected 24 polling stations, he now says they were 36. This petition lacks merit," stated Nyagarama.
