Renowned lawyer Ahmednassir Abdullahi has expressed delight in the recent statement by the Department of Immigration citing that it will follow Court orders served in a manner as prescribed by law.
According to Ahmednassir, the statement by the department is a clear indication that the government will obey Court orders and in the process a reassurance for the rule of law.
The lawyer made the remarks in line with the suspension of passports belonging to Siaya Senator James Orengo and businessman Jimi Wanjigi.
"Glad to hear that court orders will be obeyed by our beloved and benevolent government...reassuring for the rule of law....," tweeted Ahmednassir on Tuesday.
In a statement on Tuesday, the director of the Department of Immigration Maj Gen (Rtd) Gordon Kihalangwa pointed out that the department 'shall always comply with Court orders upon being served in the prescribed manner as required by law'.
Kihalangwa further points out that the department was not notified of the Court order lifting the suspension of the passports belonging to Orengo and Wanjigi and the two could thus not be allowed to proceed with their planned flight out of the country.
"When the two arrived at the airport, they were requested to avail copies of the said court orders but they had none. Instead, they showed some writings on their phones purporting to be court orders. The two could therefore not be allowed to proceed with their journey until copies of the said orders were availed," further read Kihalangwa's statement.
The two planned to travel to Zimbabwe for the burial of Opposition leader Morgan Tsvangirai today (Tuesday).
