President Uhuru Kenyatta will still have his victory nullified should any Kenyan challenge it in court after October 26th, says Moseti Moseti.
With opposition having bowed out over delayed IEBC reforms, the electoral body has still vowed to go on with elections.
Should NASA frustrate voting in her strongholds, he says, the outcome will be nullified in the end in compliance with article 138(2).
“Assuming Uhuru wins on 26th and the result is challenged, he will still suffer the same fate. Elections may not take place in all constituencies as required.
“Also, the legitimacy of his leadership can be challenged and that is the headache. This is why Uhuru has to reach Raila Odinga for talks,” he says.
A defiant Odinga has maintained that he will not be part of the polls, causing confusion among legal experts due to incoherence in the country’s laws.
Jubilee party insists that it will take part in the polls with, or without Odinga’s presence.
