A PSV trade union has gone to court to challenge the new regulations that propose instant fines for traffic offenses considered to be minor.
Through lawyer George Miyare, the Kenya National Union of Cooperative Staff (KNUCS) sued National Transport and Safety Authority (NTSA) and Transport Cabinet Secretary James Macharia over the said law that was gazetted in September.
Miyare said that Mr Macharia was attempting to allow enforcement of arbitrary rules by the NTSA where transport sector workers will be denied their right to a fair trial.
In the rules earlier outlined by Macharia, offenses such as using mobile phones while driving will attract fines of between Sh500 and Sh10,000.
However, KNUCS says the regulations must be temporarily suspended until their case is heard and determined.
