A family in Kangundo town, Machakos County, has been summoned to appear in court after a man who alleges to have married their late daughter filed a case against them, for refusing hi to bury her.
The family of the late Teresia Ndunge Mulaa has for the last three weeks been involved in wrangles with a man named Chris Kyalo who came out after her death and said he had married their daughter.
Kyalo, who is a re-known businessman in Kangundo town on Thursday moved to Kangundo Law Courts accusing the family of denying him the rights to bury his wife.
Kyalo was represented in court by J.N Kimeu and Company Associates while the family of the late Ndunge was represent by Mutunga Murabi and Associate Advocates.
The two lawyers of prosecution side and the accused sides presented their formal complaints before Senior Principal Magistrate Japheth Bii in Kangundo Law courts.
The case was mentioned and postponed to May 11, 2015 after which the ruling will be expected a month from then.
According to the brother of the late Teresia, Cosmus Mutuku cited that they had been taken to court after a man they had never known blocked them from taking their sisters’ body from the morgue after they had planned her funeral.
“We are in court following a case filed by Chris Kyalo. My sister has never talked about being married to anyone and he had never come home formally. However we tried considering him and called him for a negotiation but he instead abused my mother and other elders,” said Mutuku.
The family is therefore set to wait longer to bury their daughter.
