A land case that was referred back by a Kisii civil court to village elders in Risa has been successfully determined, a village elder has said.

The case involved complainant Wilson Kemonde and defendant Jackson Mokua where the latter is said to have purchased the piece of land in 1980 but did not pay the full agreed amount of Sh60,000 but only managed half of the sum.

The plaintiff had sued Mr Mokua over non-compliance and wanted him evicted from the piece of land upon refund by him. The case was referred to village elders for consensus since both sides lacked vital supporting documents.

But on Wednesday, Elijah Orina, the area village elder, said both sides had reached an amicable agreement under the supervision of over 10 elders, with Mr Kemonde ordered to pay Sh50,000 for him to take back the land.

“We have agreed though it took us quite some time to settle the matter. Since the plaintiff wanted the buyer to get out of the land, and the buyer was willing to do so, he agreed to pay a small sum to cater for any development that has been done on the land,” Mr Orina said.

“It was a bit simple because both didn’t have documents. The plaintiff didn’t show a document about the amount that remained while the defendant had no tittle deed. But for the matter of justice, we had to come up with the consensus,” he added.

Mr Mokua was given an ultimatum of two weeks to relocate a posh mill on the half hectare plot.
