The National Youth Service scandal cannot be used to give political mileage to former Devolution Cabinet Secretary Anne Waiguru.
11 suspects accused of money laundering Sh791 million in the scam want Waiguru barred from commenting on the case during her campaigns.
On Thursday, the suspects told a Nairobi court that Waiguru has been using the case to gain political mileage. They also accused her of trying them in public.
The 11 include Lawyer Patrick Ogola, Samuel Wachenje, Josephine Kabura, Martin Gachara Wanjohi, Jedida Wangari, Ben Gethi, John Kago, Anthony Gethii Kihara, Benson Gachoka, Benson Gethi, John Hope Vandamme and Charity Wangui.
They say the former CS’s statements in public are prejudicial and causing they are being published in the media and they want Waiguru prohibited from using the saga seeking the Kirinyaga governor's seat.
Milimani Senior principal magistrate Martha Mutuku heard that Waiguru's continued remarks are likely to affect the determination of the case based on the fact that she was adversely linked to it at the beginning.
"We urge the court to restrain Waiguru from making any further comments as the matter is already before court," said Lawyer Maina Wachira.
The suspects also want the court to restrain the parliamentary accounts committee from summoning them for further interrogation saying they have already been grilled by relevant bodies and charged before the court.
Victor Mule, the State lawyer, however said the Director of Public Prosecution (DPP) has no powers to bar the PAC from summoning suspects. He urged the court to refer the matter to the High court for interpretation.
