Kirinyaga Governor Anne Waiguru now wants the High Court to throw out the application by Narc Kenya leader Martha Karua which asks that her petition be heard and determined by a three-judge bench.
Speaking on Monday, Waiguru argued that the application did not have any merit and asked the the Kerugoya High Court to promptly dismiss it with costs.
Through her lawyers, Kamotho Waiganjo, Andrew Muchigi and Paul Nyamondi, Waiguru said that the petition was not of immense public interest and therefore it was not important that a bench be set up to hear it.
The governor also argued that the matter be heard by a single judge since it was not a complex one.
"This is an ordinary petition that can be heard and concluded in one week and it does not warrant the formation of a three judge bench," her lawyer Mr Nyamondi said.
The defence lawyers further submitted that Karua failed to prove to the court that the matter raised weighty legal questions and should be disregarded.
