A hate speech case Kabete lawmaker Ferdinand Waititu and his Gatundu South counterpart Moses Kuria failed to take off on Tuesday due to missing of a key witness.

According to the prosecution, a police officer who was supposed to testify in the case had travelled upcountry. 

Harrison Kinyanjui and Cliff Ombeta lawyers of the accused called for the case to be closed due to lack of seriousness from the prosecution. 

Magistrate Charity Oluoch declined defense lawyer's request but instead warned the prosecution that there will be no more adjournment of the case.

Kuria and Waititu were present in court for the start of the hearing of the case which was mentioned on October 5, 2016.
