Renowned legal scholar, Prof Makau Mutua and human rights activist Maina Kiai have written to the JSC asking it to admit petition against Chief Justice David Maraga by Nyeri Town MP Wambugu Ngunjiri.
Last week, Ngunjiri had filed a petition against Maraga over alleged misconduct only to be prevailed upon by President Uhuru Kenyatta.
And even before its withdrawal, the two, who were adversely mentioned by Ngunjiri as the masterminds behind nullification of Kenyatta’s victory by Supreme Court, now wants to face him head-on.
“It is clear from the tone, sequencing and juxtaposition of the content where Mutua and Kiai are mentioned in the petition was specifically done to create impression that we don’t respect courts,” read part of the letter to JSC.
The letter further said:” It basically translates to that we are not law abiding citizens and our aim is to destroy constitutionally established institutions.”
In his petition, Wambugu claimed that Maraga allowed civil activists to opposed to Jubilee government to fund the judiciary through International Development Law Organization.
The two are board members of the organization which is accused of being keen to subvert judicial independence.
