The court has suspended the ruling of the speaker of the National Assembly to have Ugunja MP, Opiyo Wandayi barred from accessing the Parliament for six months.
Wandayi was ejected from the parliament on March this year for blowing the whistle while the President was giving a State of the Nation address.
Speaker Justin Muturi ordered the lawmaker be suspended for six months and miss his sitting allowance for the entire period.
Judge Daniel Ogembo said that the directive was unconstitutional in the standing orders of the parliament and said the MP should not be denied the right to access parliament to represent his electorate.
Speaking after the ruling, Wandayi blamed the Speaker for misusing his position to frustrate the opposition.
"We have seen in the past the speaker of the National Assembly sidelining his Jubilee coalition which is not supposed to be the case. I want him to know that I will be back soon," said the Ugunja lawmaker.
Mbita MP, Millie Odhiambo said that the Jubilee has been swinging in the tyranny of numbers but the court will continue to do its work independently.
Let Jubilee know that they may have tyranny of numbers but we have tyranny of intelligence," said Odhiambo.
This means that Wandayi may access the parliament immediately three months after he was ejected.
