Julius Gikundi, 65, was accused of sodomising an 11-year-old boy on diverse dates between December 30 and December 31, 2013 while at Munithu Primary School in Imenti North.

Meru resident magistrate Eva Wambugu said the prosecution led by Claire Muriithi had proved the case beyond any reasonable doubt.

The prosecution told the court that on the material day, the boy was in the school field watching a football match when the accused called him to his house within and sodomised him. The following day, when the boy went back to the school’s field to cut grass, the guard called him and asked him to go to his house in the evening to usher in the New Year.

The boy returned in evening in a company of two other boys and after spending some time in the accused's house, the two left but the complainant remained.

The court was told that for the second time, Gikundi slept with the boy in his bed and sodomised him. The following day, January 1, 2014, when the boy went home at 6am, his father inquired about where he had spent the night.

The boy told his parents he had spent the night with Gikundi who had sodomised him. Gikundi had warned the boy that he would kill him if he told anyone.
