Former Kathiani MP Wavinya Ndeti has been ordered to pay Sh10 million as cost for petition she lodge against the re-election of Governor Alfred Mutua in last year’s election.

In his ruling on Friday, Machakos High Court Judge Aggrey Mucheleu said the petitioner will pay the cost of the suit as provided for in law.

The Judge while upholding Governor Mutua’s re-election said the petitioner (Wavinya Ndeti) failed to provide evidence to substantiate her allegations against Governor Mutua's re-election.

Muchelule ruled that the petition by former Kathiani MP Wavinya Ndeti challenging Mutua's re-election was not concrete to warrant nullification of the election.

Wavinya Ndeti had challenged Mutua's re-election claiming that it was marred with illegalities and irregularities.

Ndeti who was vying for the position on Kalonzo Musyoka’s Wiper party ticket further accused Governor Mutua of allegedly using county resources to fund his campaigns.

She alleged that Mutua intimidated her agents in some of the polling stations on the voting day.

Ndeti through her lawyers had asked the court to nullify Mutua's re-election and order for fresh gubernatorial election.

She claimed that the IEBC erred in declaring Mutua the Governor for the second term, noting that the will and wish of the people were subverted.

Mutua, however, rubbished Ndeti’s petition, saying it was filed based on malice and propaganda.

The governor while defending his re-election in court said he was re-elected fairly.

Mutua denied using county resources to campaign for re-election instead accusing Ndeti of malice.

The hearing of the petition was marred with controversies as Ndeti and Mutua’s lawyers often engaged in confrontations.

The IEBC declared Mutua winner in last year’s Machakos gubernatorial election garnering 238,404 votes against Ndeti’s 199,257.
