Former Kathiani MP Wavinya Ndeti has been dealt a major blow in the petition seeking to nullify the election of Machakos County boss Alfred Mutua during the August General election after a lawyer distanced himself from the petitioner’s affidavits. 

In a letter written to Justice Aggrey Muchelule, lawyer Ham Lang’at said that he does not recognize the affidavits presented by the former lawmaker.

 “It is not my deed, I did not commission the documents and none of the deponents appeared before me for commissioning of any affidavit,” read Lang’at’s letter, as quoted by Citizen. 

Mutua’s lawyer B.N Musau surprised the court when he presented a letter showing the Wavinya’s lawyer’s statement. He insisted that Ndeti had gone against the constitution while presenting her case to the court

IEBC lawyer Kimani Muhoro told the court that the politician went against the laws of the nation when filing her case. “It is a very serious violation of the law if deemed true, it amounts to striking off of this petition.”

In her defense, Wavinya through her lawyer Martin Gitonga told the presiding judge that it is not right for the two sides to present the arguments in the middle of trial.
