The application comes after High Court Judge George Odunga postponed the hearing of the case filed against the aspirant, a close ally of Wiper Party leader Stephen Kalonzo Musyoka.
Judge Odunga had asked the electoral body to allow the politician to continue with her campaigns pending investigations into the matter. He also ordered the commission to include her name in the Gazette notice of candidates contesting for different elective posts in the forthcoming general elections.
The nullification of Wavinya Ndeti came after she was accused of belonging to Wiper and Chama Cha Uzalendo, which is considered illegal as per the constitution of the country.
On her part, Ndeti has blamed political witch hunt for her woes as we head to the August general elections. The vocal aspirant has maintained that she will be on the ballot box when that time comes.
The nullification of Ndeti from the race is likely to give Mutua an upper hand in the race since she is considered the fiercest contestant.
